Learning outcomes of the course unit

  1. To introduce the most frequently used contract types in culture and arts management from the perspective of current legislation.
  2. To introduce the work and content analysis knowledge of individual types of contracts.
  3. To introduce the potential of functional use of contracts and other legal instruments for increasing legal security in relations between artists, producers and other persons in culture and arts managements.

Mode of study

Reading and analysing contracts. Interpretation and creation of contract provisions. Practical advice and instructions. Moderated discussions.

Prerequisites and co-requisites

Students must, prior to registration, complete courses: 305PR1, 305PR2, 305PR3, 305PR4 Law 1-4, 206APR1 Copyright 1.

Course contents

  1. Purchase I. (limits and embedding of contracts, structure, essential purchasing features, ancillary agreements, clauses, use in practice, examples).
  2. Purchase II. (analysis and discussion on particular cases of sample purchase agreement texts).
  3. Joint organizational, collaboration, co-production (essential features, distinguishing criteria, limits, examples from practice).
  4. Hosting, Excursion (fundamental features and limits, typical and defining contract elements, examples from practice).
  5. Sponsoring, advertising contracts (fundamental features and limits, distinguising elements vs donations, examples from practice).
  6. Donation (fundamental features and limits, distiguising elements vs sponsoring, examples from practice).
  7. Grant contracts I. (fundamental features and limits, distinguishing elements vs donation, analysis of contracts from practice).
  8. Grant contracts II. (analysis and discussion on particular examples of sample purchase contract texts).
  9. Loans, borrowings, rentals, credit (fundamental features and limits, distinguishing criteria, examples from practice).
  10. Personal rights and personal data protection (limits to personal rights, embedding contracts, examples from practice, personal data).
  11. Survey of all types of contractual relationships in theatre operations.
  12. Final summary.

Assessment methods and criteria

During the semester independent preparations for classes and participation for at least 70% of classes.

An additional condition for successful completion of the course is the completion of the credit interview on general contract issues and exercises simulating the process of preparatoins or negotiating content and conditions for a particular contract type.
